Spyware can be embedded in hardware itself.
This isn't about Android, but some desktop network cards are able to 
manage TCP connections even without any operating system present:

AMT can accept TCP connections, and also potentially can initiate 
connections, and transfer information from your computer out to whoever 
it is hardwired to.
